ERAU called me today, he no longer works for them.

I also took a hard look at the photo, and I believe the black braid would show up if it was on the jacket, I believe it's an enlisted jacket.

It MIGHT have something to do with me putting the then DIV CSM through RIP when he was a MSG(P) in the very first Regimental RIP class. I didn't do anything to him personally, but evidently he remembered me and told me that if I wanted to be a PSG in HIS DIV then I was going to AASLT...

Hell - I wasn't even permitted to go to the E5 board in HIS DIV (well, probably not his at that time, but you know what I mean) without first going to AASLT. I went, but it wasn't long after that I was moving across the airfield....

It appears he is at best a Specialist, probably Airborne qualified, but he is wearing:
Special Forces Tab - Ranger Tab - Pathfinder Badge -SCUBA Badge - Aviator Badge -
Combat Infantryman Badge along with the rank of a Major, officer Aviation Branch insignia,
and a bunch of unearned ribbons, probably including a Purple Heart.
While using all of those claims, including Airborne, Ranger and Nightstalker quotes on yellow page
advertisements and web pages in an effort to solicit clients for his law office.

The above should be read in connection with this:

ARIZONA RULES OF PROFESSIONAL CONDUCT

ER 7.1. Communications Concerning a Lawyer's Services

A lawyer shall not make or knowingly permit to be made on the lawyer's behalf a false or misleading communication
about the lawyer or the lawyer's services. A communication is false or misleading if it contains a material misrepresentation of fact or law, or omits a fact necessary to make the statement considered as a whole not materially misleading.

[1] This Rule governs all communications about a lawyer's services, including advertising permitted by ER 7.2. Whatever means are used to make known a lawyer's services, statements about them must be truthful.

ER 8.4. Misconduct

It is professional misconduct for a lawyer to:

(a) violate or attempt to violate the Rules of Professional Conduct, knowingly assist or induce another to do so, or do so through the acts of another;

(b) commit a criminal act that reflects adversely on the lawyer's honesty, trustworthiness or fitness as a lawyer in other respects;

(c) engage in conduct involving dishonesty, fraud, deceit or misrepresentation;


The Stolen Valor Act of 2013


This Act may be cited as the ‘Stolen Valor Act of 2013

SEC. 2. FRAUDULENT REPRESENTATIONS ABOUT RECEIPT OF MILITARY DECORATIONS OR MEDALS.

(a) In General- Section 704 of title 18, United States Code, is amended--

(1) in subsection (a), by striking ‘wears,’; and

(2) so that subsection (b) reads as follows:

‘(b) Fraudulent Representations About Receipt of Military Decorations or Medals- Whoever, with intent to obtain money, property, or
other tangible benefit, fraudulently holds oneself out to be a recipient of a decoration or medal described in subsection (c)(2) or (d)
shall be fined under this title, imprisoned not more than one year, or both.
(b) Addition of Certain Other Medals- Section 704(d) of title 18, United States Code, is amended--
(1) by striking ‘If a decoration’ and inserting the following:
(1) IN GENERAL- If a decoration’;
(2) by inserting ‘a combat badge,’ after ‘1129 of title 10,’; and
(3) by adding at the end the following:
(2) COMBAT BADGE DEFINED- In this subsection, the term ‘combat badge’ means a Combat Infantryman’s Badge, Combat Action Badge,
Combat Medical Badge, Combat Action Ribbon, or Combat Action Medal.
(c) Conforming Amendment- Section 704 of title 18, United States Code, is amended in each of subsections (c)(1) and (d) by striking ‘or (b).’

Gentlemen, this person is in my AO and my State Bar. I'll be interested to learn what you all dig up.

ETA: I just saw the pictures on the website. I know who he is. He did not impress me. As for what to do, any person may file a complaint with the State Bar.

Burt, me thinks he pissed off the wrong person at the other end of the phoncon!!

I would love to be a fly on that wall next week! Oh, wait, the local Fox News has been invited to attend!

The low down thus far as I read it, someone from back in that era happens to live in the same area. Former distinguished NS called to ask WTF, but started to get an apology but NS told poser he, NS, would see him, poser, in person next week. I would not want to be on the receiving end on that visit.

The poser, from what I understand, left the service as an E-4 reservist.

Arizona requires that a bar complaint start with a telephone call to their disciplinary board. If the complaint passes screening, then they ask for supporting documents. If they decide it is a violation worth pursuing, the board actually files the complaint, not John Q. Public.

I have printed out the old and new versions of his web site;
and enlarged, color corrected and labeled the "hands in pocket" photograph; enlarged and labeled the office pictures with the Ranger Class photo and the Purple Heart license plate. I was waiting for the FOIA information -- thank you Claymore for posting that.
If Arizona agrees that a diciplinary complaint should be filed, I have the documents ready to mail to them, but it sounds like I'm way behind the power curve.

Strictly speaking, a call isn't a condition precedent to sending documents. There are reasons, but I won't bore you with them.
If you send in a letter with documents alleging misconduct that involves deception, someone will certainly review it. I know who the complaint intake person is at the Bar, and I also know one of the investigators.

Under Ethical Rule 8.3(a), I am required to report misconduct that raises a substantial question another lawyer's honesty or trustworthiness. You can PM me for contact information if you need assistance.

Very sad that this dude has everything to be proud of with his true history yet he poses as someone he is not. His service may have been short, but it was not insignificant. Not sure what his discharge status was as I do not see it on the FOIA forms, but I presume it was Honorable. Why ruin that service?
