Veterans Affairs to release health information

Well, crap. Short of the long is that the VA is releasing your data unless you explicitly deny by handing in an arbitrary form by Monday.

Ben is a buddy of mine and an attorney (and veteran).

This form stops people from getting your health care data via eHealth. Does LEO, Government LEO use eHealth?

I live 80+ miles from a facility that would accept this, and the office is closed today. I won't be able to get it in before Monday. This is horseshit.

Looks like it may have been updated to January 2020. I need to dig in, but it’s still bullshit you have you opt out instead of opting in.

In another thread I commented that nobody at the VA is against me, and nobody is for me. I may need to reevaluate that comment.

Well , thanks to the heads up from you guys, I downloaded the two forms filled em out and drove to the Tomah VA. The dude at the desk was okay about it , but he seriously tried talking me out of submitting them!

I just started back working at The V.A. part time an had to take a test on HIPAA called Privacy & HIPAA Training.

If you say/do something one way it could be violation of HIPAA, but if you process the information a different way it's OK. If an request comes from say a judge in written then it has to go to who handles the request. These type are not turned down, there are other types from individual that will be review an could be turned down. This will be up to the PRIVACY OFFICER to make that call.

Just the way I understand it an that is because I just took the test on Privacy & HIPAA Training. (an Passed the test) That was last Thursday

Called around. It's true you have to opt-out. If you skip it, your shit will automatically be shared.

Here's the info, which is also from the link I shared above.

Notice to Veterans: The VA Health Information Exchange Opt Out Form, VA Form 10-10164, is now available online at www.va.gov, on this website, or in Release of Information Office (ROI) at VA medical centers. The form must be signed, mailed and/or hand carried to a Veteran's local Release of Information Office. VA Form 10-0484 will expire September 30, 2019 and the new form VA 10-10164, will need to be submitted. Currently, there are no means of submitting the form electronically.
VA Systems will begin opting all Veterans into health information sharing, beginning January 2020.
Here are organizations that have agreements with the VA, and with whom may be sent your info without your prior consent.

Note that there is some bi-directional sharing, as marked on the listing. Meaning, some providers may simply cull your info from VA, and then visa versa, should the VA want to ping them for services you may have had at their locations.

I dropped both forms in my local VA ROI office this morning...

If you look at the "partner" list linked in CV's post, then dig into their individual web sites, you'll find that almost every org on that list can, and likely does, sell the information they hold to various "partners" and data aggregators "to further the body of data available to research"...

Opt out. They won't honor it, in the long run... But, you'll be on the moral (and, for the moment) legal high ground.

I dropped mine on the desk at my va this afternoon. It went into the stack of others. I don’t hold out hope it will be honored so I walked across the grass with my hands in my pockets as I left.

Right. Because then we would have an electronic record. And it would go to a database. And we could then demand simple accountability measures.

But hey, let's just have veterans drop off a paper form, at some local office, with a faceless bureaucrat, who doesn't give two fucks about whether that form is ever processed.

Is this the best we're going to allow to happen?
